Limited Warranty for Domestic or Commercial Use – Bamboo Flooring Our superior design, production technologies and style allow us to provide one of the best warranties in the industry subject only to a few common sense exclusions. Lifetime Structural Warranty. The Manufacturer warrants that the Flooring sold under this Warranty is, at the time of sale, free from defects in material and manufacture and that it conforms to the Manufacturer’s standard specifications for the Flooring model. The Manufacturer further warrants that it will replace, less the recommended 5% allowed for installation waste, any planks with defective bonding, at no cost to you, the end consume, as long as you own your own home. Twenty Five Year Pre-Finish Warranty. For pre-finished Flooring, The Manufacturer warrants that the aluminium oxide pre-finish on the Flooring is, at the time of sale, free from defects in material and manufacture and that it conforms to The Manufacturer's standard specifications for the finish. The Manufacturer further warrants that when the Flooring is maintained according to The Manufacturer’s instructions and used for its intended purpose, the finish will not wear through to the underlying Flooring or separate from the Flooring as a result of a manufacturing defect for twenty Five (25) years from the date of sale in residential applications and 10 years in commercial. This warranty excludes any indentations, scratches, or damages cause by negligence, exposure to extreme heat, dryness or water saturation, accidents, abuse, misuse, indentations from heels or pets, stains as a result of chemical or industrial products, insufficient protection or improper alterations of the original manufactured product, or damage to the finish caused by damage to the underlying Flooring. General Conditions and Exclusions of Warranty This warranty applies only to permanently habited buildings. Where a property is scheduled to be uninhabited for any reasonable length of time outside normal occupancy conditions it is important to remember that measures may need to be taken maintain the warrantable level of relative humidity between %30-%70. The Manufacturer's installation instructions MUST be followed as a condition for these Warranties to have effect. You may obtain these instructions directly from the Manufacturer. These Warranties do not cover damage or defects resulting from or in any way attributable to:
This Warranty extends to the buyer and to the owner of the first structure in which the Flooring is installed during the Warranty Period. The Properties of Bamboo Bamboo in many respects behaves like natural timber. It is hygroscopic and it absorbs and expels moisture in response to environmental and climatic site conditions. For this reason correct expansion gaps must be allowed for during installation as the bamboo will expand and contract as moisture levels change. When prevailing conditions are either very wet or very dry and/or rapid changes in relative humidity occur, any flooring including bamboo may cup, crown or display surface checking or irregularities. This is due to extreme expansion or contraction. These conditions are beyond the control of the manufacturer, who accordingly stipulates that the average monthly relative humidity where the bamboo flooring is installed must be maintained at between %30 and %70. In order to achieve this humidifiers or evaporative coolers may be required in very dry climates and air conditioners may be required in moist and humid areas. Failure to maintain relative humidity within these levels will void this warranty. Relative humidity meters are available from electronics retailers, are inexpensive, and should be used wherever there are concerns over the sites relative humidity levels. Disclaimer of Implied Warranties The above warranties are the exclusive and sole warranties given by The Manufacturer for the Flooring. They supersede any prior, contrary or additional representations, whether oral or written. The Manufacturer disclaims all other warranties - whether express, implied or statutory including any warranty of merchantability, any warranty of fitness for a particular purpose, and any implied warranties arising from course of dealing or usage of trade. What We'll Provide if the Flooring is Non-compliant. If during the applicable Warranty Period, the Flooring does not conform to the preceding Warranties, the owner of the Flooring shall notify the The Manufacturer in writing, within 3 days of discovering the non-conformity. The Manufacturer will provide, at its option, one of the following:
Commencement of Warranty. The warranty commences upon delivery of the product to the customer, or when the product is paid for in full, whichever is sooner, excepting that no warranty applies at until such time as the final invoice as submitted by the manufacturer has been paid in full. These remedies shall be the exclusive and sole remedies for any breach of warranty. If the Flooring does not comply with the Warranty, the owner of the Flooring must notify The Manufacturer in writing within three (3) days after delivery. The notice must describe the location and nature of the non-conformity. The owner must give The Manufacturer reasonable opportunity to examine the claimed nonconformity before undertaking any repairs, removal or replacement. The owner must present the original invoice as proof of the date of purchase. Compliance with the requirements of this paragraph is a condition to coverage under the Warranty: if these requirements are not complied with, The Manufacturer will have no obligation to remedy any non-conformity. Exclusion of Incidental and Consequential Damages. In no event shall The Manufacturer be liable for any incidental, special, indirect or consequential damages, whether resulting from non-delivery or from the use, misuse or inability to use the product or from defects in the product or from The Manufacturer’s own negligence. |
